It is an offence not to comply with the requirements of an enforcement notice and if it becomes necessary legal action may be taken to secure compliance with an enforcement notice. The recipient of an enforcement notice may be prosecuted in the Magistrates Court and receive a fine and costs.
More than one prosecution case may be taken against a recipient who has not complied with an enforcement notice and in extreme circumstances the National Park Authority has power to enter the land and carry out the works in default of the recipient. This is called direct action and is extremely rare due to the financial costs to the Local Planning Authority.
